GENERAL CONDITIONS OF RENTAL
RENTAL CONTRACT
The rental of the designated vehicle is made under the following conditions accepted by the named lessee.
Article 1 – USE OF THE CAR
Under penalty of being excluded from insurance coverage and thus being uninsured, the lessee undertakes not to let anyone other than themselves or those approved by BORA BORA BEST RENT drive the car, and for whom they guarantee, to use the vehicle only for personal needs, not to participate in any competitions, not to use the vehicle for illegal purposes or for the transportation of goods, not to propel or tow any vehicle or trailer, not to carry passengers for a fee, not to apply for customs documents directly, not to overload the rented vehicle by carrying more passengers than indicated on the registration card, not to use the vehicle outside the island of BORA BORA without paying a surcharge, and not to use the vehicle on tracks. It is strictly forbidden to smoke or vape in the rental car.
Article 2 – CONDITION OF THE CAR
The lessee acknowledges having received the rented vehicle in perfect condition of cleanliness and equipped with all its accessories in working order. The car must be returned in the same state of cleanliness and operation, failing which the lessee will have to pay the amount of these cleanings or restorations. The five tires are in good condition, without cuts. In case of deterioration of any of them due to causes other than normal wear, the lessee agrees to replace it immediately with a tire of the same size and similar wear.
Article 3 – FUEL AND OIL
Fuel is the responsibility of the lessee. The lessor is required to perform a weekly check of the levels. For rentals longer than a week, the lessee undertakes to report any anomalies they might notice under penalty of having to pay compensation for abnormal wear.
Article 4 – MAINTENANCE AND REPAIRS
Normal mechanical wear is the responsibility of BORA BORA BEST RENT. All repairs arising from abnormal wear or negligence on the part of the lessee will be at their expense and carried out by us. In the event that the vehicle is immobilized, repairs can only be carried out after written agreement and according to the directives of BORA BORA BEST RENT; they must be supported by a paid and detailed invoice; the replaced defective parts must be presented with the paid invoice. Under no circumstances can the lessee claim damages, whether for delay in the delivery of the car, cancellation of the rental, or immobilization in the case of repairs carried out during the rental. BORA BORA BEST RENT’s liability can never be engaged even in the event of accidents involving people or property caused by construction defects or prior repairs.
Article 5 – INSURANCE
Only drivers approved by BORA BORA BEST RENT may claim the status of insured as defined by the decree of January 7, 1959. They are covered for the following risks:
- For accidents caused to third parties, unlimited sum for bodily accidents, and limited for material and immaterial damages. The contract provides a driver's guarantee, and passengers are insured by the Civil Liability (RC).
- Against theft and fire of the rented vehicle except for serious negligence by the lessee
- The lessee's attention is drawn to the fact that damages to the vehicle are not covered by any insurance
- and that whatever the circumstances in which these damages occur, the lessee is responsible, with respect to BORA BORA BEST RENT, for personally bearing the costs of repair and immobilization, the lessee naturally retaining the possibility of recourse against a third party possibly responsible for said damages
- Under penalty of losing the insurance, the lessee undertakes:
To declare to BORA BORA BEST RENT within 24 hours, and immediately to the police authorities, any accident, theft or fire, even partial;
- To specify in their declaration the circumstances, date, place and time of the accident, the name and address of the witnesses, the number of the opponent's car, the name of their insurance company and the policy number;
- Not to discuss responsibility or deal or settle with third parties regarding the accident;
- The clothes and objects transported are in no way guaranteed;
- The car is insured only for the duration of the rental. After this period, and unless the extension is accepted, BORA BORA BEST RENT declines all responsibility for accidents that the lessee might cause and for which they would be responsible;
- Finally, there is no insurance for any driver without a valid driving license. The risk "damages to the rented vehicle" are no longer guaranteed when the driver is drunk driving and/or under the influence of drugs;
- BORA BORA BEST RENT declines all responsibility for accidents to third parties or damages to the car that the lessee might cause during the rental period if they have deliberately provided BORA BORA BEST RENT with false information regarding their identity, address or the validity of their driving license and for any accident occurring outside the island of BORA BORA or off paved roads. The insurance will then cover no damage;
- The minimum age required to rent a BORA BORA BEST RENT vehicle is 23 years, more than 2 years of a Class B license and having never been subject to a withdrawal, suspension or cancellation of the driving license in the past five years.
Article 6 – RENTAL – DEPOSIT – EXTENSION
The price of the rental as well as the deposit are determined according to current rates and payable in advance. The deposit may not be used in any case for an extension of the rental. In order to avoid any dispute, and in case the lessee would like to keep their car for a time longer than initially agreed, they must, after acceptance by BORA BORA BEST RENT, send the amount of the ongoing rental, under penalty of exposing themselves to legal prosecution for misappropriation of the car or breach of trust.
Article 7 – REPATRIATION OF THE CAR
The lessee is formally prohibited from abandoning the vehicle. In case of material impossibility, it will be repatriated at the expense and care of the lessee, the remaining rental being due until the return of the vehicle.
Article 8 – CAR DOCUMENT
Upon completion of the rental and return of the car, the lessee must hand over the registration certificate and all necessary documents for its operation. Failing that, rental fees will continue to be charged until their delivery to BORA BORA BEST RENT.
Article 9 – LIABILITY
The lessee remains solely responsible for fines, penalties, and summonses issued against them. BORA BORA BEST RENT reserves the right to additional billing within 30 days following the date of closure of the rental contract.
Article 10 – JURISDICTION
Any dispute under this contract shall be brought before the competent jurisdiction of French Polynesia.
Article 11 – DEDUCTIBLE IN CASE OF ACCIDENT OR DAMAGE
A deductible must be paid in the event of an accident or damage to the vehicle. See the amount of the deductible according to the rented vehicle in Article 12.

The fees and penalties listed below apply in case of damages, violations, or specific requests during the vehicle rental:
